1. Agreement and operator
By accessing or using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
M Squared is operated by SurfBreak Digital, a Panama-based sole proprietorship. “M Squared,” “we,” “us,” and “our” refer to that operator. Questions may be sent to surfbreakdigital@gmail.com.
2. The service
M Squared provides diagnostic website analysis for search readiness, AI discoverability, customer trust, and actionability. Current offers include:
- Free Quick Visibility Check: a limited website check and Website Visibility Score, subject to availability and rate limits.
- Full Website Visibility Analysis: a $49.99 one-time analysis for one public website, with expanded evidence, prioritized findings, and recommendations.
- Website Visibility Monitoring: a $29-per-month subscription for one website, including recurring reanalysis, score movement, new and resolved findings, changing priorities, and a monitoring report.
Published prices are in U.S. dollars unless stated otherwise. Features, reasonable crawl limits, and report presentation may evolve as the methodology and service improve.
3. Diagnostic results, not guarantees
The service measures observable website signals using the methodology available at the time of analysis. Search engines, AI systems, competitors, algorithms, and market conditions are outside our control. No score, finding, report, or recommendation guarantees rankings, indexing, AI citations, traffic, leads, sales, revenue, or any other outcome.
AI may help explain verified evidence or draft recommendations in paid reports. The Website Visibility Score is generated from versioned, rules-based checks; AI does not independently invent or alter the score. You remain responsible for deciding whether and how to act on any recommendation.
4. Websites you submit
You may submit only publicly accessible websites that you own, manage, are authorized to evaluate, or have a legitimate purpose to analyze. You authorize us and our service providers to access public pages and technical signals needed to perform the requested analysis.
You must not use the service to access private systems, evade access controls, conduct abusive or bulk scanning, overload a website, test for exploitation, interfere with others, or violate law or third-party rights. We may limit, suspend, or refuse requests that appear unsafe, abusive, automated beyond permitted limits, or outside the intended service.
5. Purchases and subscriptions
Payments are processed by Stripe. You agree to provide accurate contact and billing information and authorize the applicable charge.
A monitoring subscription renews monthly at the displayed price until canceled. You may cancel through the Stripe customer portal made available by the service. Cancellation prevents future renewal; access continues through the end of the then-current paid billing period unless law requires otherwise.
Except where required by applicable law, a one-time digital analysis is non-refundable once processing has begun, and subscription charges already paid are non-refundable and are not prorated. If you are charged twice, cannot receive a purchased report because of a verified service failure, or believe a charge is unauthorized, contact surfbreakdigital@gmail.com so we can investigate.
Taxes, if any are legally applicable to you, remain subject to applicable law and the checkout terms presented at purchase.
6. Report access and acceptable use
Private report links and access tokens are intended for the purchaser and people the purchaser authorizes. You are responsible for protecting those links and for activity conducted through them.
You may use and share your purchased report within your business and with contractors helping improve the submitted website. You may not resell the service, reproduce the analyzer as a competing product, reverse engineer scoring or security systems, remove proprietary notices, or use outputs to train or build a substantially similar service without written permission.
7. Ownership
You retain ownership of your website and content. M Squared and its licensors retain ownership of the service, software, methodology, scoring framework, report design, branding, and other proprietary materials. These Terms grant only the limited rights needed to use the service and your report; no other rights are transferred.
Feedback you voluntarily provide may be used to improve the service without obligation to you, provided we do not publicly identify you as its source without permission.
8. Availability and changes
We work to provide a reliable service but do not promise uninterrupted or error-free availability. Public websites may block automated access, change during a scan, or expose incomplete signals. We may maintain, modify, suspend, or discontinue parts of the service and may update methodology, limits, or features. Paid obligations already accepted will be handled reasonably and consistently with applicable law.
9. Disclaimer and limitation of liability
To the maximum extent permitted by Panama law, the service and reports are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or a particular business result.
To the maximum extent permitted by law, M Squared will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, rankings, traffic, or business opportunities arising from the service or your use of recommendations. Our aggregate liability arising from a paid service will not exceed the amount you paid us for the service giving rise to the claim during the twelve months before the event. Nothing in these Terms excludes liability that cannot lawfully be excluded.
10. Responsibility for misuse
You are responsible for your use of the service and for changes you make to a website. To the extent permitted by law, you agree to defend and hold M Squared harmless from third-party claims, losses, and reasonable costs caused by your unlawful use, violation of these Terms, or infringement of another person's rights.
11. Governing law and disputes
These Terms are governed by the laws of the Republic of Panama, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be submitted to the competent courts of the Republic of Panama, unless applicable consumer law requires a different forum or procedure.
Before filing a claim, please contact surfbreakdigital@gmail.com and provide enough information for us to try to resolve the issue.
12. General terms
If a provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a business reorganization, sale, or succession. These Terms and the Privacy Policy form the agreement governing the service unless a separate written agreement applies.
We may update these Terms as the service or law changes. The effective date above identifies the current version. Continued use after an update means you accept the revised Terms to the extent permitted by law.
